5、農(nong)藥經銷秩序比較混亂
首先(xian)表現在眾多(duo)經(jing)(jing)營(ying)(ying)主體(ti)(ti)不合格。一是(shi)無(wu)證經(jing)(jing)營(ying)(ying),既沒(mei)有營(ying)(ying)業(ye)執(zhi)照業(ye)沒(mei)有農(nong)資經(jing)(jing)營(ying)(ying)許(xu)可(ke)(ke)證;二是(shi)超范圍經(jing)(jing)營(ying)(ying),有些單位(wei)和個人(ren)只(zhi)有農(nong)資經(jing)(jing)營(ying)(ying)許(xu)可(ke)(ke)證,卻(que)經(jing)(jing)營(ying)(ying)農(nong)藥,或者只(zhi)有零售資格卻(que)零售批發一起做;三是(shi)轉(zhuan)讓證照,一些個體(ti)(ti)經(jing)(jing)營(ying)(ying)者沒(mei)有經(jing)(jing)營(ying)(ying)許(xu)可(ke)(ke)證卻(que)掛靠(kao)在供銷(xiao)社或農(nong)技(ji)推廣站等單位(wei)的名下經(jing)(jing)營(ying)(ying)農(nong)藥。據(ju)調查,目前(qian)農(nong)藥經(jing)(jing)營(ying)(ying)者合法的只(zhi)有不到一半。
其次是經(jing)營主體素(su)質不(bu)高(gao)(gao)。經(jing)營者本身不(bu)懂農(nong)藥(yao),不(bu)能一般識(shi)別假冒偽劣產(chan)品(pin);不(bu)能給予農(nong)民用藥(yao)指導(dao),難以推廣科(ke)技含(han)量高(gao)(gao)的新型農(nong)藥(yao)產(chan)品(pin);不(bu)能為(wei)農(nong)民提供產(chan)前、產(chan)中和產(chan)后的技術服務。
第三是(shi)市(shi)場(chang)競爭(zheng)不(bu)平(ping)(ping)等。隨著我國市(shi)場(chang)經(jing)(jing)濟的(de)進(jin)展,農(nong)藥(yao)經(jing)(jing)銷格局(ju)發生了很大(da)變化,由原來的(de)供銷社(she)一統天下演(yan)變成三足鼎立:供銷社(she)系(xi)統、農(nong)技站植保站下屬的(de)經(jing)(jing)銷部(bu)(bu)和個(ge)體民(min)營企(qi)業(ye),尤以民(min)營企(qi)業(ye)發展迅(xun)速,現已占到(dao)了農(nong)藥(yao)銷售(shou)的(de)一半以上(shang)。但農(nong)業(ye)技術部(bu)(bu)門(men)既是(shi)農(nong)藥(yao)經(jing)(jing)營的(de)管理(li)部(bu)(bu)門(men),又是(shi)市(shi)場(chang)化的(de)銷售(shou)單位(wei),必然會影響到(dao)公平(ping)(ping)競爭(zheng),而對于自己企(qi)業(ye)的(de)違法(fa)違規行為,主管部(bu)(bu)門(men)也很難進(jin)行處罰。
6、農藥(yao)行業可持續發展(zhan)受到局限
農(nong)藥行業(ye)(ye)(ye)是個關(guan)聯性強的(de)行業(ye)(ye)(ye),生(sheng)(sheng)產本身涉及(ji)資源配(pei)置(zhi)、員工的(de)健康(kang)安全(quan)、排(pai)放(fang)造成的(de)污染等(deng),使(shi)用(yong)(yong)過程涉及(ji)用(yong)(yong)戶(hu)人身安全(quan)、作物(wu)的(de)豐欠(qian)和質量等(deng),長(chang)遠則影(ying)響到(dao)生(sheng)(sheng)態環(huan)境(jing)和食(shi)品(pin)安全(quan)等(deng),所以必須統籌協調(diao)國家、企(qi)業(ye)(ye)(ye)、員工、用(yong)(yong)戶(hu)各(ge)方利益(yi),樹立科學、和諧、可持續(xu)的(de)發展(zhan)觀(guan)。但由于多方面原(yuan)因,農(nong)藥行業(ye)(ye)(ye)宏觀(guan)調(diao)控不力,市(shi)場競爭不規范,可持續(xu)發展(zhan)受到(dao)很(hen)大(da)局限。如市(shi)場準(zhun)(zhun)入標準(zhun)(zhun)過低和不明確,大(da)量不具備基本生(sheng)(sheng)產經營條件的(de)企(qi)業(ye)(ye)(ye)參與農(nong)藥生(sheng)(sheng)產經營,不但造成資源浪費、環(huan)境(jing)污染、威脅食(shi)品(pin)安全(quan)等(deng)直(zhi)接后果,而且破壞了(le)生(sheng)(sheng)產企(qi)業(ye)(ye)(ye)、銷售商(shang)、員工、用(yong)(yong)戶(hu)和人類與環(huan)境(jing)之間的(de)良性互動關(guan)系(xi)。
這點在農藥出口中也有突出表現。我國雖然已經成為出口大國,但規模與金額并沒有同步增長,反而呈現相反趨勢,1995年我國農藥出口3300多美元/噸,2003年僅2664美元/噸,平均價格下降了24%!此外還存在著國際上嚴格限制的高污染、高消耗農藥生產向我國轉移的情況。 三、加(jia)強和改善我(wo)國農藥(yao)生產(chan)經營管理的建議
1、健全和完善(shan)有(you)關法律法規
我國農(nong)藥(yao)(yao)管(guan)理雖然已(yi)經納(na)入了(le)法(fa)治化(hua)軌(gui)道(dao),但有(you)關法(fa)律法(fa)規還有(you)待完善。鑒于農(nong)藥(yao)(yao)在農(nong)業(ye)(ye)(ye)生(sheng)產(chan)(chan)中的(de)(de)(de)(de)重要(yao)(yao)作用,尤其是(shi)對于食品(pin)(pin)安全的(de)(de)(de)(de)重要(yao)(yao)意義,有(you)必要(yao)(yao)把《農(nong)藥(yao)(yao)管(guan)理條例》升格(ge)為(wei)《農(nong)藥(yao)(yao)管(guan)理法(fa)》,以更有(you)效地(di)調動政府(fu)和民(min)間資(zi)(zi)(zi)源(yuan),加(jia)強(qiang)對農(nong)藥(yao)(yao)生(sheng)產(chan)(chan)經營的(de)(de)(de)(de)監督管(guan)理,為(wei)農(nong)業(ye)(ye)(ye)生(sheng)產(chan)(chan)和食品(pin)(pin)安全提供基礎保(bao)障。而在基本法(fa)律框架下,某些不(bu)(bu)合理或不(bu)(bu)適(shi)應(ying)的(de)(de)(de)(de)具體(ti)規定(ding)也應(ying)進行修改、完善。如對高(gao)毒農(nong)藥(yao)(yao)要(yao)(yao)嚴格(ge)限(xian)制(zhi)(zhi),逐(zhu)步降(jiang)低其比例直至(zhi)取消;重視農(nong)藥(yao)(yao)的(de)(de)(de)(de)環(huan)保(bao)標(biao)準(zhun),從生(sheng)產(chan)(chan)企(qi)業(ye)(ye)(ye)的(de)(de)(de)(de)生(sheng)產(chan)(chan)條件和生(sheng)產(chan)(chan)工藝到農(nong)藥(yao)(yao)產(chan)(chan)品(pin)(pin)質量標(biao)準(zhun),都要(yao)(yao)有(you)嚴格(ge)、明(ming)確、細化(hua)的(de)(de)(de)(de)環(huan)保(bao)指標(biao)(如對企(qi)業(ye)(ye)(ye)污染排(pai)放要(yao)(yao)有(you)總量控(kong)制(zhi)(zhi)、產(chan)(chan)品(pin)(pin)質量標(biao)準(zhun)中應(ying)有(you)有(you)害或不(bu)(bu)明(ming)雜(za)質限(xian)制(zhi)(zhi)),標(biao)準(zhun)的(de)(de)(de)(de)執行對于所有(you)農(nong)藥(yao)(yao)企(qi)業(ye)(ye)(ye)(不(bu)(bu)論大、小企(qi)業(ye)(ye)(ye),不(bu)(bu)管(guan)內資(zi)(zi)(zi)外資(zi)(zi)(zi))都一(yi)視同仁(ren);農(nong)藥(yao)(yao)登(deng)記中增加(jia)知(zhi)識產(chan)(chan)權(quan)審核標(biao)準(zhun),加(jia)強(qiang)知(zhi)識產(chan)(chan)權(quan)保(bao)護,鼓勵企(qi)業(ye)(ye)(ye)研(yan)發。
2、建立科學合理的農藥管理體(ti)系
建立科學合(he)理(li)的農藥行業管理(li)體(ti)系(xi),從研(yan)究開發、生產(chan)流通(tong)到儲存使(shi)用等全過程都要(yao)強化管理(li)。重點在于加(jia)大知識產(chan)權保護(hu)、三(san)廢排放監管、經營流通(tong)監管、農技服務等方面的管理(li)力度。
應進一步(bu)理(li)(li)順政府管理(li)(li)體(ti)制(zhi),改(gai)革和(he)完善現行(xing)(xing)(xing)管理(li)(li)方(fang)式。鑒于我國目前的體(ti)制(zhi)狀況和(he)現實可能,應明(ming)(ming)確農業管理(li)(li)部(bu)門(men)在農藥生(sheng)產和(he)經營管理(li)(li)中的主(zhu)導地位。《農藥管理(li)(li)條例(li)》雖然(ran)賦予(yu)了農業部(bu)門(men)以管理(li)(li)權,但在具體(ti)工(gong)作中卻沒(mei)(mei)有執(zhi)法(fa)權;發改(gai)、工(gong)商、商務(wu)、質(zhi)檢(jian)、環保(bao)、專(zhuan)利等(deng)部(bu)門(men)雖然(ran)也從不同(tong)角度(du)參與農藥管理(li)(li),但相關(guan)權責(ze)(ze)并沒(mei)(mei)有明(ming)(ming)確規定。所以,應在法(fa)律上對相關(guan)農藥管理(li)(li)部(bu)門(men)的責(ze)(ze)任和(he)權力進行(xing)(xing)(xing)規制(zhi),明(ming)(ming)確職責(ze)(ze)分工(gong),建(jian)立相關(guan)協調機(ji)制(zhi),同(tong)時建(jian)立對失職、瀆職行(xing)(xing)(xing)為的追(zhui)究制(zhi)度(du)。
對(dui)于農(nong)(nong)(nong)(nong)藥生產企(qi)業(ye)的(de)(de)投資審(shen)核(he),可(ke)(ke)由發(fa)改委、農(nong)(nong)(nong)(nong)業(ye)部(bu)共同擬訂(ding)市場準(zhun)入標準(zhun),由農(nong)(nong)(nong)(nong)業(ye)部(bu)門(men)操(cao)作。對(dui)農(nong)(nong)(nong)(nong)藥的(de)(de)登記(ji)管(guan)理、許(xu)可(ke)(ke)證發(fa)放,在修訂(ding)有(you)關標準(zhun)的(de)(de)基礎(chu)上(shang),由農(nong)(nong)(nong)(nong)業(ye)管(guan)理部(bu)門(men)負責。環保部(bu)門(men)應對(dui)農(nong)(nong)(nong)(nong)藥生產、使用對(dui)農(nong)(nong)(nong)(nong)業(ye)和(he)(he)環境造成的(de)(de)現實(shi)和(he)(he)潛在影(ying)響進(jin)行檢測評估,并把(ba)有(you)關結果及時(shi)(shi)通報(bao)農(nong)(nong)(nong)(nong)業(ye)、工商(shang)(shang)等部(bu)門(men),提(ti)高農(nong)(nong)(nong)(nong)藥生產經營管(guan)理的(de)(de)針對(dui)性(xing)和(he)(he)及時(shi)(shi)性(xing)。工商(shang)(shang)、商(shang)(shang)務、質檢等部(bu)門(men)配合農(nong)(nong)(nong)(nong)業(ye)管(guan)理部(bu)門(men)對(dui)農(nong)(nong)(nong)(nong)藥流通進(jin)行監(jian)督(du)檢查和(he)(he)行政執法(fa)。
同時,也要體現有所為有所不為的原則,對于市場機制可以解決的問題政府不加干預,而對于員工健康安全、產品質量控制、環境保護、食品安全等則要加大監管力度。
3、提高農藥行業的準入(ru)門檻(jian)
由于(yu)農藥(yao)(yao)生產(chan)的(de)(de)技術(shu)水平、環保投(tou)入(ru)、質量控制以(yi)至損失賠償等(deng)都(dou)與投(tou)資(zi)(zi)規模密切相關,建(jian)議對采用傳統(tong)工藝的(de)(de)原(yuan)藥(yao)(yao)生產(chan)、制劑加(jia)工等(deng)不(bu)(bu)(bu)同生產(chan)方式規定最(zui)(zui)低(di)(di)投(tou)資(zi)(zi)額(e)和(he)最(zui)(zui)低(di)(di)環保投(tou)入(ru)比例。如(ru)原(yuan)藥(yao)(yao)生產(chan)企(qi)業(ye)的(de)(de)最(zui)(zui)低(di)(di)資(zi)(zi)本(ben)金不(bu)(bu)(bu)能(neng)低(di)(di)于(yu)3000萬人民幣,加(jia)工企(qi)業(ye)最(zui)(zui)低(di)(di)資(zi)(zi)本(ben)金不(bu)(bu)(bu)能(neng)低(di)(di)于(yu)500萬人民幣,環保投(tou)入(ru)不(bu)(bu)(bu)能(neng)低(di)(di)于(yu)投(tou)資(zi)(zi)總(zong)額(e)的(de)(de)15%。同時,盡快(kuai)建(jian)立(li)農藥(yao)(yao)生產(chan)企(qi)業(ye)類似于(yu)藥(yao)(yao)品生產(chan)GMP標(biao)準的(de)(de)認證制度,新建(jian)立(li)企(qi)業(ye)須達(da)到標(biao)準方準投(tou)產(chan),已(yi)建(jian)企(qi)業(ye)限期(qi)達(da)標(biao),不(bu)(bu)(bu)合格的(de)(de)淘汰。通(tong)過必要的(de)(de)行政(zheng)手(shou)段和(he)市場手(shou)段,規范(fan)農藥(yao)(yao)生產(chan)秩序,促進(jin)農藥(yao)(yao)生產(chan)企(qi)業(ye)升級。
對現(xian)有(you)農藥生產企業(ye)(ye)要(yao)(yao)按(an)照國家法律法規要(yao)(yao)求進行嚴格(ge)監(jian)督檢查(cha),對于使(shi)用(yong)國家明令禁(jin)止的落后(hou)技術(shu)工藝的,應責(ze)令立即(ji)停(ting)止使(shi)用(yong);產品質(zhi)量不達標禁(jin)止出廠;達不到環保標準的生產企業(ye)(ye)要(yao)(yao)堅決(jue)予(yu)以關閉。對于生產和產品質(zhi)量問題造成嚴重后(hou)果的案件,要(yao)(yao)追究有(you)關人員的行政和法律責(ze)任。
4、整(zheng)頓(dun)農藥(yao)經銷秩序(xu)
重(zhong)新審(shen)定農藥(yao)經(jing)銷(xiao)標(biao)準,對(dui)(dui)于(yu)農藥(yao)經(jing)營者要有(you)資(zi)(zi)金(jin)和技術(shu)的(de)雙重(zhong)要求。農藥(yao)批(pi)發企(qi)業注(zhu)(zhu)冊(ce)資(zi)(zi)本最低不(bu)能低于(yu)50萬元,零(ling)售(shou)企(qi)業注(zhu)(zhu)冊(ce)資(zi)(zi)本不(bu)能少于(yu)5萬元。批(pi)發企(qi)業必(bi)須(xu)有(you)一定比例的(de)專業技術(shu)人(ren)員(yuan),零(ling)售(shou)企(qi)業的(de)銷(xiao)售(shou)人(ren)員(yuan)也必(bi)須(xu)經(jing)過專門培訓,具(ju)備(bei)必(bi)要的(de)農藥(yao)使用知識。為此,地(di)方農業管(guan)理部門應對(dui)(dui)農藥(yao)經(jing)銷(xiao)企(qi)業銷(xiao)售(shou)人(ren)員(yuan)進行免費培訓,考核合格后才能從事(shi)農藥(yao)銷(xiao)售(shou)。
配合我國(guo)清理整(zheng)頓市場秩(zhi)序(xu)的(de)工(gong)作(zuo),建(jian)議對(dui)目(mu)前我國(guo)農(nong)(nong)(nong)藥經(jing)銷市場進行專項(xiang)清理,取締(di)不(bu)合格的(de)、非法的(de)經(jing)營者,嚴厲查處銷售(shou)假冒偽劣產品坑(keng)農(nong)(nong)(nong)害(hai)農(nong)(nong)(nong)的(de)事(shi)件。現在農(nong)(nong)(nong)技站(zhan)、植保站(zhan)等政(zheng)(zheng)(zheng)府管理部(bu)門下屬的(de)農(nong)(nong)(nong)藥經(jing)銷企業(ye)(ye)應(ying)立即脫鉤,改制成獨立的(de)經(jing)營實體。至于基層(ceng)農(nong)(nong)(nong)業(ye)(ye)管理(技術(shu))部(bu)門的(de)經(jing)費問題(ti),則應(ying)由國(guo)家財(cai)政(zheng)(zheng)(zheng)全額(e)負擔,這(zhe)部(bu)分支(zhi)(zhi)(zhi)(zhi)出(農(nong)(nong)(nong)業(ye)(ye)技術(shu)支(zhi)(zhi)(zhi)(zhi)持(chi))可以在財(cai)政(zheng)(zheng)(zheng)中單列,作(zuo)為我國(guo)農(nong)(nong)(nong)業(ye)(ye)支(zhi)(zhi)(zhi)(zhi)持(chi)政(zheng)(zheng)(zheng)策(ce)的(de)一部(bu)分。這(zhe)樣既有(you)利(li)于農(nong)(nong)(nong)藥銷售(shou)的(de)公平競爭,又加強了(le)政(zheng)(zheng)(zheng)府管理農(nong)(nong)(nong)業(ye)(ye)的(de)力度;有(you)關財(cai)政(zheng)(zheng)(zheng)支(zhi)(zhi)(zhi)(zhi)持(chi)既不(bu)違反世貿(mao)組織有(you)關規定(農(nong)(nong)(nong)業(ye)(ye)技術(shu)支(zhi)(zhi)(zhi)(zhi)持(chi)可以列入“綠箱(xiang)”政(zheng)(zheng)(zheng)策(ce)),又實實在在地(di)支(zhi)(zhi)(zhi)(zhi)援了(le)農(nong)(nong)(nong)業(ye)(ye)。
5、規(gui)范農藥產(chan)品(pin)出(chu)口管理及產(chan)品(pin)質量
我(wo)(wo)國(guo)(guo)農(nong)(nong)(nong)(nong)藥(yao)產(chan)(chan)品(pin)(pin)出(chu)(chu)口(kou)(kou)量(liang)(liang)逐(zhu)年增(zeng)加,而(er)農(nong)(nong)(nong)(nong)藥(yao)產(chan)(chan)品(pin)(pin)在全世界范圍(wei)內(nei)均(jun)作為(wei)特殊商品(pin)(pin),因此各國(guo)(guo)均(jun)采用較為(wei)嚴格的登記制度,這對我(wo)(wo)國(guo)(guo)農(nong)(nong)(nong)(nong)藥(yao)產(chan)(chan)品(pin)(pin)質(zhi)量(liang)(liang)、出(chu)(chu)口(kou)(kou)農(nong)(nong)(nong)(nong)藥(yao)的技術資料準備均(jun)提出(chu)(chu)較高的要(yao)求。目前(qian)我(wo)(wo)國(guo)(guo)農(nong)(nong)(nong)(nong)藥(yao)出(chu)(chu)口(kou)(kou)企(qi)業(ye)采取讓利于進(jin)/出(chu)(chu)口(kou)(kou)商,由他們承擔登記費(fei)用和(he)風險的做法,將產(chan)(chan)品(pin)(pin)出(chu)(chu)口(kou)(kou)到其(qi)他國(guo)(guo)家(jia)。但(dan)包括東南(nan)亞國(guo)(guo)家(jia)在內(nei)的我(wo)(wo)國(guo)(guo)農(nong)(nong)(nong)(nong)藥(yao)傳統出(chu)(chu)口(kou)(kou)國(guo)(guo)紛(fen)紛(fen)加強對農(nong)(nong)(nong)(nong)藥(yao)進(jin)口(kou)(kou)的管理措施,同時隨(sui)著我(wo)(wo)國(guo)(guo)農(nong)(nong)(nong)(nong)藥(yao)出(chu)(chu)口(kou)(kou)量(liang)(liang)的增(zeng)加,在國(guo)(guo)外農(nong)(nong)(nong)(nong)藥(yao)質(zhi)量(liang)(liang)糾(jiu)紛(fen)也(ye)時有發生。為(wei)維護我(wo)(wo)國(guo)(guo)農(nong)(nong)(nong)(nong)藥(yao)行業(ye)的聲譽,減少不必要(yao)的國(guo)(guo)際貿易糾(jiu)紛(fen),應該加強和(he)規范農(nong)(nong)(nong)(nong)藥(yao)產(chan)(chan)品(pin)(pin)出(chu)(chu)口(kou)(kou)管理,從規范農(nong)(nong)(nong)(nong)藥(yao)企(qi)業(ye)生產(chan)(chan)做起(qi),提高農(nong)(nong)(nong)(nong)藥(yao)產(chan)(chan)品(pin)(pin)質(zhi)量(liang)(liang)。
農(nong)藥行業的(de)發展不(bu)能(neng)以犧牲環(huan)境為(wei)代(dai)價,更不(bu)能(neng)允許以轉移污染的(de)方式維(wei)持農(nong)藥行業的(de)利潤。應(ying)該加強(qiang)環(huan)保要求,嚴格執法(fa),避(bi)免單(dan)純(chun)為(wei)謀求出口而(er)出現的(de)污染轉移問(wen)題。 |
