2008年全國農(nong)資(zi)打假專(zhuan)項治理行動實施(shi)方案

  為認真貫徹落實中央農(nong)(nong)村工(gong)作會議、國(guo)務院(yuan)全(quan)國(guo)農(nong)(nong)業(ye)抗災減災和(he)(he)春(chun)耕(geng)生(sheng)產工(gong)作會議以及全(quan)國(guo)農(nong)(nong)業(ye)工(gong)作會議精神,切實保護(hu)農(nong)(nong)民利(li)益,保障農(nong)(nong)業(ye)生(sheng)產安全(quan)和(he)(he)農(nong)(nong)產品質量安全(quan),根據國(guo)務院(yuan)關于整頓和(he)(he)規范市場(chang)經濟秩序工(gong)作的(de)總體部(bu)(bu)署和(he)(he)國(guo)家六(liu)部(bu)(bu)委《2008年全(quan)國(guo)農(nong)(nong)資打假和(he)(he)監管工(gong)作要(yao)點(dian)》的(de)要(yao)求(qiu),制定(ding)本方案。

  一、工作思路和目標

  (一(yi))工作(zuo)思路(lu)。貫(guan)徹(che)落實(shi)科學發(fa)展觀,圍繞保(bao)(bao)護農(nong)(nong)(nong)(nong)民根本利益,保(bao)(bao)障(zhang)農(nong)(nong)(nong)(nong)業(ye)生產(chan)安(an)全特別是(shi)確保(bao)(bao)當前(qian)抗災救災恢復生產(chan)和(he)(he)春(chun)耕(geng)備(bei)耕(geng)順利進(jin)行(xing),鞏固農(nong)(nong)(nong)(nong)產(chan)品(pin)質量(liang)安(an)全專(zhuan)項整(zheng)治成果,保(bao)(bao)障(zhang)農(nong)(nong)(nong)(nong)產(chan)品(pin)質量(liang)安(an)全,堅持標本兼治、打防結合和(he)(he)屬地管(guan)理原則(ze),嚴格落實(shi)農(nong)(nong)(nong)(nong)資(zi)(zi)監(jian)管(guan)責任制,狠抓(zhua)重點品(pin)種和(he)(he)農(nong)(nong)(nong)(nong)資(zi)(zi)產(chan)品(pin)審批管(guan)理、生產(chan)監(jian)管(guan)、市場規范和(he)(he)科學使用等重點環節,大力(li)推(tui)(tui)動農(nong)(nong)(nong)(nong)資(zi)(zi)信用體系建設,開展放心(xin)農(nong)(nong)(nong)(nong)資(zi)(zi)下鄉(xiang)進(jin)村示范,強(qiang)化服務指(zhi)導,推(tui)(tui)進(jin)執法規范化建設,著力(li)構建農(nong)(nong)(nong)(nong)資(zi)(zi)監(jian)管(guan)長效機(ji)制,推(tui)(tui)動農(nong)(nong)(nong)(nong)資(zi)(zi)市場秩(zhi)序持續好轉。

  (二)工作目標。通過(guo)各(ge)級各(ge)部門的(de)共同努力,使農(nong)(nong)(nong)資(zi)(zi)生產(chan)經營行為進(jin)(jin)一(yi)(yi)(yi)步(bu)規范,農(nong)(nong)(nong)民(min)群眾(zhong)質(zhi)量意識和維權能力進(jin)(jin)一(yi)(yi)(yi)步(bu)提(ti)高,放心農(nong)(nong)(nong)資(zi)(zi)下(xia)鄉進(jin)(jin)村(cun)覆蓋范圍進(jin)(jin)一(yi)(yi)(yi)步(bu)擴大,農(nong)(nong)(nong)資(zi)(zi)市場秩(zhi)序進(jin)(jin)一(yi)(yi)(yi)步(bu)好轉(zhuan),農(nong)(nong)(nong)民(min)群眾(zhong)滿意程度進(jin)(jin)一(yi)(yi)(yi)步(bu)提(ti)高,農(nong)(nong)(nong)資(zi)(zi)監管長效機(ji)制基本(ben)形成。通過(guo)開展農(nong)(nong)(nong)藥登記管理年活動,加強農(nong)(nong)(nong)藥、獸藥、飼料和飼料添加劑監管,從(cong)源頭上保障(zhang)農(nong)(nong)(nong)產(chan)品質(zhi)量安全。

  二、工作重點

  (一)突出重點品種(zhong),強化(hua)市場整治。以(yi)種(zhong)子(種(zhong)苗)、農(nong)藥(yao)、肥料(liao)、獸藥(yao)、飼(si)料(liao)和飼(si)料(liao)添(tian)加劑(ji)、農(nong)機及零配件(jian)、水產苗種(zhong)、農(nong)膜為(wei)重點,強化(hua)市場監(jian)管,堅(jian)決(jue)查處違法(fa)行為(wei)。

  種(zhong)(zhong)(zhong)子(zi)(zi)監(jian)管重點(dian):以水稻、玉米、棉花等主(zhu)要農作物種(zhong)(zhong)(zhong)子(zi)(zi)為重點(dian),加大以兩(liang)雜種(zhong)(zhong)(zhong)子(zi)(zi)為重點(dian)的質量監(jian)督抽查(cha)力度(du),擴(kuo)大抽查(cha)范圍,堅決(jue)查(cha)處生(sheng)產經(jing)(jing)營(ying)假(jia)劣種(zhong)(zhong)(zhong)子(zi)(zi)、無證生(sheng)產經(jing)(jing)營(ying)、經(jing)(jing)營(ying)推(tui)廣應當審(shen)定(ding)而(er)未經(jing)(jing)審(shen)定(ding)通過的種(zhong)(zhong)(zhong)子(zi)(zi)、超范圍經(jing)(jing)營(ying)、未按(an)規定(ding)建立(li)經(jing)(jing)營(ying)檔案(an)、品(pin)種(zhong)(zhong)(zhong)包裝標(biao)簽介(jie)紹與審(shen)定(ding)公(gong)告表述不符等違(wei)法行為;嚴(yan)格品(pin)種(zhong)(zhong)(zhong)審(shen)定(ding),規范品(pin)種(zhong)(zhong)(zhong)命名,解決(jue)品(pin)種(zhong)(zhong)(zhong)多(duo)、亂(luan)、雜等問題(ti)。

  農(nong)(nong)藥(yao)(yao)監管重(zhong)(zhong)點(dian):嚴(yan)格(ge)按照2007年底頒布的6項(xiang)農(nong)(nong)藥(yao)(yao)管理(li)(li)新規(gui)定(ding),規(gui)范(fan)農(nong)(nong)藥(yao)(yao)登(deng)記管理(li)(li),切實解決(jue)農(nong)(nong)藥(yao)(yao)登(deng)記管理(li)(li)中產(chan)品數量(liang)多(duo)、“一(yi)藥(yao)(yao)多(duo)名”和標(biao)簽(qian)管理(li)(li)不規(gui)范(fan)等(deng)突出問題;加大(da)農(nong)(nong)藥(yao)(yao)產(chan)品質量(liang)和農(nong)(nong)藥(yao)(yao)標(biao)簽(qian)檢(jian)查力度,以(yi)防(fang)治小麥(mai)、水稻病蟲害用藥(yao)(yao)為重(zhong)(zhong)點(dian)對象,以(yi)鄉、村(cun)一(yi)級農(nong)(nong)藥(yao)(yao)代銷零(ling)售點(dian)為重(zhong)(zhong)點(dian)區域,堅決(jue)查處生產(chan)經(jing)營假劣農(nong)(nong)藥(yao)(yao)、無(wu)登(deng)記證(zheng)生產(chan)、添加未登(deng)記成分、擴大(da)使(shi)用范(fan)圍、一(yi)證(zheng)多(duo)用、套(tao)證(zheng)或冒證(zheng)、標(biao)簽(qian)不符合規(gui)定(ding)以(yi)及肥料(liao)產(chan)品標(biao)稱具有(you)農(nong)(nong)藥(yao)(yao)功(gong)能(neng)等(deng)違(wei)法(fa)(fa)行為。嚴(yan)厲打(da)擊非法(fa)(fa)生產(chan)、銷售和使(shi)用甲胺磷等(deng)禁用高毒農(nong)(nong)藥(yao)(yao)的違(wei)法(fa)(fa)行為。

  肥(fei)料(liao)監(jian)管(guan)重(zhong)點:以(yi)復混肥(fei)、有機肥(fei)料(liao)、葉面肥(fei)、微生(sheng)物(wu)肥(fei)料(liao)及床土調酸劑為(wei)重(zhong)點,嚴查(cha)有效成分不足、包裝標識不規范(fan)、夸大使用(yong)效果、一證(zheng)多用(yong)、假冒偽造(zao)登記(ji)證(zheng)等違法行為(wei)。加(jia)強對(dui)配(pei)方肥(fei)定點生(sheng)產(chan)(chan)(chan)企(qi)業產(chan)(chan)(chan)品質(zhi)量的監(jian)測,建立(li)完善配(pei)方肥(fei)質(zhi)量追(zhui)溯(su)管(guan)理制度。加(jia)強對(dui)肥(fei)料(liao)登記(ji)產(chan)(chan)(chan)品的后續管(guan)理。

  獸藥(yao)監管重點:按照(zhao)《2008年獸藥(yao)市場集(ji)中整治行動方案》確定的(de)重點品種和重點區域,嚴(yan)查生(sheng)產(chan)經營假劣獸藥(yao)、無證生(sheng)產(chan)經營、有(you)(you)效成分(fen)含量(liang)(liang)不(bu)足、標(biao)簽說明(ming)書不(bu)規范(fan)、非法(fa)生(sheng)產(chan)獸用生(sheng)物制品等違法(fa)行為;加大禽流感疫(yi)(yi)苗(miao)、豬藍耳病疫(yi)(yi)苗(miao)等重大動物疫(yi)(yi)病疫(yi)(yi)苗(miao)的(de)質(zhi)量(liang)(liang)監管;嚴(yan)厲(li)打擊生(sheng)產(chan)經營使用違禁藥(yao)物和其他有(you)(you)毒有(you)(you)害化合物的(de)行為,采取(qu)有(you)(you)力(li)措施,取(qu)締(di)國家禁用的(de)獸藥(yao)。

  飼(si)(si)料和(he)飼(si)(si)料添(tian)加劑(ji)監(jian)管重點(dian):嚴(yan)厲打擊生產(chan)(chan)經營假劣(lie)飼(si)(si)料和(he)飼(si)(si)料添(tian)加劑(ji)、無證(zheng)生產(chan)(chan)、包裝標簽(qian)不符合(he)規定等(deng)違(wei)法行為;嚴(yan)查在飼(si)(si)料加工和(he)養殖環(huan)節添(tian)加瘦肉(rou)精、“蛋白精”、萊(lai)克(ke)多(duo)巴胺、孔雀石綠、硝基呋喃等(deng)違(wei)禁藥物(wu)(wu)(wu)和(he)非法添(tian)加物(wu)(wu)(wu);組(zu)織開展全國飼(si)(si)料產(chan)(chan)品質量安全監(jian)測(ce)工作,重點(dian)監(jian)測(ce)飼(si)(si)料衛生指標、飼(si)(si)料中(zhong)違(wei)禁藥物(wu)(wu)(wu)、反芻動物(wu)(wu)(wu)飼(si)(si)料中(zhong)牛羊(yang)源性成(cheng)分(fen)。

  農(nong)(nong)機(ji)(ji)(ji)監管重點:以財(cai)政資金補(bu)貼購置的(de)農(nong)(nong)機(ji)(ji)(ji)具(ju)為(wei)(wei)重點,開展質(zhi)(zhi)量(liang)(liang)監督工作(zuo)(zuo)。積極(ji)開展農(nong)(nong)機(ji)(ji)(ji)產(chan)(chan)品(pin)質(zhi)(zhi)量(liang)(liang)調(diao)查、投訴和(he)打假工作(zuo)(zuo),確保補(bu)貼機(ji)(ji)(ji)具(ju)的(de)產(chan)(chan)品(pin)質(zhi)(zhi)量(liang)(liang)和(he)售后服(fu)務水平。完善農(nong)(nong)機(ji)(ji)(ji)質(zhi)(zhi)量(liang)(liang)投訴監督體系,及(ji)時處理(li)重大(da)、突(tu)發(fa)質(zhi)(zhi)量(liang)(liang)事(shi)故和(he)集中投訴事(shi)件,堅決打擊制售假冒偽劣機(ji)(ji)(ji)具(ju)的(de)行為(wei)(wei)。加強農(nong)(nong)機(ji)(ji)(ji)試驗鑒定體系建設,提高農(nong)(nong)機(ji)(ji)(ji)試驗鑒定工作(zuo)(zuo)質(zhi)(zhi)量(liang)(liang),做好(hao)國(guo)家支(zhi)持(chi)推廣的(de)農(nong)(nong)機(ji)(ji)(ji)產(chan)(chan)品(pin)目錄(lu)制定工作(zuo)(zuo)。

  水產(chan)苗(miao)(miao)(miao)種監管重點:加大水產(chan)苗(miao)(miao)(miao)種生(sheng)(sheng)產(chan)許可制度(du)(du)的實施(shi)力度(du)(du),嚴肅查處苗(miao)(miao)(miao)種生(sheng)(sheng)產(chan)環(huan)節(jie)使用硝基呋(fu)喃、氯霉(mei)素和(he)孔(kong)雀石綠等禁用藥(yao)(yao)物和(he)有毒(du)有害化(hua)學物質的行為(wei)(wei),提高(gao)水產(chan)苗(miao)(miao)(miao)種質量。督促苗(miao)(miao)(miao)種生(sheng)(sheng)產(chan)企(qi)業建(jian)立生(sheng)(sheng)產(chan)記錄、用藥(yao)(yao)記錄及銷售(shou)(shou)記錄,建(jian)立可追溯制度(du)(du)。嚴厲打擊(ji)以(yi)次充(chong)好、以(yi)劣充(chong)優和(he)銷售(shou)(shou)帶(dai)病水產(chan)苗(miao)(miao)(miao)種的行為(wei)(wei)。

  熱作(zuo)種苗(miao)監管重點:以天(tian)然(ran)(ran)(ran)橡(xiang)膠(jiao)(jiao)種苗(miao)監管為重點,在(zai)天(tian)然(ran)(ran)(ran)橡(xiang)膠(jiao)(jiao)定(ding)植高峰期,加(jia)大對(dui)天(tian)然(ran)(ran)(ran)橡(xiang)膠(jiao)(jiao)良(liang)種補(bu)貼定(ding)點生(sheng)(sheng)產(chan)基地出圃(pu)種苗(miao)質(zhi)量(liang)(liang)的抽(chou)檢力度,并對(dui)天(tian)然(ran)(ran)(ran)橡(xiang)膠(jiao)(jiao)良(liang)種補(bu)貼定(ding)點生(sheng)(sheng)產(chan)企(qi)業進行(xing)全面(mian)檢查,建(jian)立質(zhi)量(liang)(liang)追(zhui)溯制度,對(dui)其(qi)他(ta)天(tian)然(ran)(ran)(ran)橡(xiang)膠(jiao)(jiao)苗(miao)木(mu)生(sheng)(sheng)產(chan)企(qi)業進行(xing)定(ding)期或不定(ding)期抽(chou)查。同時,加(jia)大對(dui)市場(chang)上銷售的其(qi)他(ta)熱作(zuo)種苗(miao)質(zhi)量(liang)(liang)抽(chou)查力度。

  農膜監(jian)管重點:加強(qiang)對農膜產(chan)品(pin)價(jia)格的例行監(jian)測和使用環節質量的信息反饋。大力推廣多功(gong)能、高(gao)效能、防老化農膜,加強(qiang)應用技術指導(dao),開展農膜產(chan)品(pin)識假(jia)辨假(jia)維權知(zhi)識宣傳,幫助(zhu)農民樹立正(zheng)確(que)的消費觀念,拒絕使用低(di)價(jia)偽劣農膜產(chan)品(pin)。

  (二)突出審批(pi)管理,強(qiang)化市(shi)場(chang)準(zhun)(zhun)(zhun)入(ru)。各地農(nong)業部門要(yao)依據《行政許(xu)可(ke)法(fa)(fa)(fa)》的規(gui)定(ding),嚴格履行法(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)規(gui)賦予(yu)的審批(pi)管理職責,嚴把市(shi)場(chang)準(zhun)(zhun)(zhun)入(ru)關(guan)(guan)口。嚴格執行農(nong)資產(chan)(chan)品(pin)(pin)審定(ding)、登(deng)記(ji)、許(xu)可(ke)的有關(guan)(guan)條件(jian)、程序和標準(zhun)(zhun)(zhun),嚴禁(jin)降低(di)標準(zhun)(zhun)(zhun)和越權(quan)(quan)審批(pi)。依法(fa)(fa)(fa)加強(qiang)證后管理,監督轄區內(nei)農(nong)資生產(chan)(chan)、經營企(qi)業嚴格執行審批(pi)要(yao)求,保(bao)證農(nong)資產(chan)(chan)品(pin)(pin)質(zhi)量。堅(jian)決實施退出機制,對于有重(zhong)大缺陷的農(nong)資產(chan)(chan)品(pin)(pin),要(yao)及時撤銷(xiao)(xiao)登(deng)記(ji)審批(pi),停止經營推廣;對已不符(fu)合法(fa)(fa)(fa)定(ding)資質(zhi)條件(jian)或者有嚴重(zhong)違法(fa)(fa)(fa)行為的企(qi)業,要(yao)依法(fa)(fa)(fa)注(zhu)(zhu)銷(xiao)(xiao)或者吊銷(xiao)(xiao)其許(xu)可(ke)(批(pi)準(zhun)(zhun)(zhun))證。要(yao)強(qiang)化信(xin)息(xi)(xi)發布制度,及時公告審批(pi)、撤銷(xiao)(xiao)、注(zhu)(zhu)銷(xiao)(xiao)、吊銷(xiao)(xiao)等(deng)有關(guan)(guan)信(xin)息(xi)(xi),增強(qiang)工作(zuo)透明度,維護公眾(zhong)知情權(quan)(quan)。通過(guo)加強(qiang)審批(pi)管理,正本清源,保(bao)證農(nong)資市(shi)場(chang)良好的競(jing)爭(zheng)秩序。

  (三)加大檢查力度(du),狠(hen)抓市場整頓。各地(di)農(nong)業(ye)(ye)部門要會同發展改(gai)革、質(zhi)監等部門,加強對農(nong)資生產(chan)(chan)企業(ye)(ye)的(de)監管,督(du)促其嚴格執行產(chan)(chan)品(pin)(pin)質(zhi)量管理制(zhi)(zhi)度(du),不(bu)斷完善(shan)產(chan)(chan)品(pin)(pin)質(zhi)量控制(zhi)(zhi)體系。要建立(li)農(nong)資生產(chan)(chan)企業(ye)(ye)監督(du)檢查制(zhi)(zhi)度(du),積極開展農(nong)資企業(ye)(ye)誠信評價。督(du)促企業(ye)(ye)建立(li)產(chan)(chan)品(pin)(pin)召回(hui)制(zhi)(zhi)度(du),對有質(zhi)量問(wen)題或者(zhe)存(cun)在較大缺陷的(de)產(chan)(chan)品(pin)(pin)要一(yi)律停止銷(xiao)售,已銷(xiao)售的(de)要追回(hui)。要圍繞重點產(chan)(chan)品(pin)(pin)、重點區(qu)域、重點對象,組織力量開展拉(la)網式大檢查,重點檢查農(nong)資產(chan)(chan)品(pin)(pin)批發市場和(he)縣鄉(xiang)農(nong)資集散地(di);重點監控有多次違法(fa)行為記錄的(de)經營戶以及鄉(xiang)村(cun)流動(dong)商販;嚴厲打(da)擊非法(fa)制(zhi)(zhi)售假冒偽劣(lie)農(nong)資的(de)小作坊和(he)黑窩點。

  (四)加強案件(jian)移(yi)(yi)送(song),嚴(yan)(yan)查(cha)重大案件(jian)。針對當前(qian)違法(fa)分子(zi)“當地(di)(di)制假,異地(di)(di)銷售”的(de)特點(dian),各地(di)(di)在(zai)查(cha)處違法(fa)行(xing)為(wei)過程(cheng)中,必須嚴(yan)(yan)格按(an)照“五不(bu)放過”原則,徹(che)底查(cha)清假劣農(nong)資(zi)(zi)的(de)來(lai)源(yuan)和去向。涉及跨(kua)行(xing)政(zheng)區(qu)域(yu)的(de)案件(jian),要(yao)按(an)照農(nong)業(ye)部(bu)《農(nong)業(ye)生產資(zi)(zi)料監督管理工作暫(zan)行(xing)規(gui)定》的(de)要(yao)求(qiu),及時上報案件(jian)信(xin)息,發(fa)送(song)協(xie)查(cha)通報,確保徹(che)查(cha)源(yuan)頭(tou),端掉窩點(dian),消除(chu)危(wei)害。各地(di)(di)要(yao)認真落實農(nong)業(ye)部(bu)、公安部(bu)《關(guan)于在(zai)農(nong)資(zi)(zi)打假中做好涉嫌(xian)犯罪(zui)案件(jian)移(yi)(yi)送(song)工作的(de)意(yi)見(jian)》,做好農(nong)業(ye)行(xing)政(zheng)執法(fa)與(yu)刑事司法(fa)的(de)銜接(jie),及時移(yi)(yi)送(song)涉嫌(xian)犯罪(zui)案件(jian),依法(fa)追究刑事責(ze)任,堅決杜(du)絕“有(you)案不(bu)送(song)、以罰代(dai)刑”。

  (五)突出投(tou)入品(pin)使(shi)(shi)用(yong)(yong)(yong)環節監管,保障農產(chan)(chan)(chan)(chan)(chan)品(pin)質(zhi)量安全。各地農業(ye)部門要(yao)切實履(lv)行(xing)《農產(chan)(chan)(chan)(chan)(chan)品(pin)質(zhi)量安全法(fa)》、《國務院關于加強食品(pin)等產(chan)(chan)(chan)(chan)(chan)品(pin)安全監督(du)管理的(de)特別規(gui)定》賦予的(de)職責。督(du)促農產(chan)(chan)(chan)(chan)(chan)品(pin)生(sheng)產(chan)(chan)(chan)(chan)(chan)者切實履(lv)行(xing)法(fa)律(lv)義務,建(jian)立農業(ye)投(tou)入品(pin)使(shi)(shi)用(yong)(yong)(yong)記錄(lu)(lu)臺賬。以(yi)無(wu)公害農產(chan)(chan)(chan)(chan)(chan)品(pin)生(sheng)產(chan)(chan)(chan)(chan)(chan)基(ji)地、農業(ye)產(chan)(chan)(chan)(chan)(chan)業(ye)化(hua)龍頭企業(ye)原料基(ji)地、蔬菜水(shui)果生(sheng)產(chan)(chan)(chan)(chan)(chan)基(ji)地、養(yang)殖小區、規(gui)模養(yang)殖場、健康養(yang)殖示范場、標(biao)準化(hua)示范區、農產(chan)(chan)(chan)(chan)(chan)品(pin)批發(fa)市(shi)場為重(zhong)點對象,重(zhong)點檢查是(shi)否按法(fa)律(lv)規(gui)定建(jian)立生(sheng)產(chan)(chan)(chan)(chan)(chan)記錄(lu)(lu),有(you)無(wu)使(shi)(shi)用(yong)(yong)(yong)禁(jin)用(yong)(yong)(yong)農藥(yao)(yao)、獸(shou)藥(yao)(yao)或其(qi)他化(hua)學物質(zhi)以(yi)及超限用(yong)(yong)(yong)范圍使(shi)(shi)用(yong)(yong)(yong)農藥(yao)(yao)、獸(shou)藥(yao)(yao)的(de)行(xing)為,是(shi)否存在(zai)不(bu)遵守安全間隔期(qi)或休藥(yao)(yao)期(qi)規(gui)定銷售農產(chan)(chan)(chan)(chan)(chan)品(pin)的(de)行(xing)為,是(shi)否存在(zai)使(shi)(shi)用(yong)(yong)(yong)違法(fa)包裝(zhuang)(zhuang)物、保鮮劑、添加劑等材料,是(shi)否按規(gui)定進行(xing)農產(chan)(chan)(chan)(chan)(chan)品(pin)包裝(zhuang)(zhuang)和(he)標(biao)識(shi)。

  (六)加(jia)強(qiang)執(zhi)法(fa)(fa)抽檢,強(qiang)化農(nong)資(zi)(zi)產(chan)品(pin)(pin)質(zhi)量(liang)監管(guan)。農(nong)資(zi)(zi)產(chan)品(pin)(pin)質(zhi)量(liang)抽檢是(shi)農(nong)業行政(zheng)執(zhi)法(fa)(fa)的重要環節,也是(shi)及(ji)時(shi)(shi)發(fa)現和(he)處(chu)(chu)理假(jia)冒偽劣農(nong)資(zi)(zi)產(chan)品(pin)(pin)的基(ji)本(ben)手段。各地(di)要結合(he)當地(di)農(nong)資(zi)(zi)市(shi)場特點和(he)存在的突出問題,科學制(zhi)定(ding)執(zhi)法(fa)(fa)抽檢計劃,有(you)針對(dui)性地(di)開(kai)展農(nong)資(zi)(zi)產(chan)品(pin)(pin)質(zhi)量(liang)執(zhi)法(fa)(fa)抽檢,進一步加(jia)大農(nong)資(zi)(zi)產(chan)品(pin)(pin)質(zhi)量(liang)抽檢力度(du),提高抽檢覆蓋率。同時(shi)(shi)要保證抽檢與依(yi)法(fa)(fa)查處(chu)(chu)的有(you)效(xiao)銜(xian)接,對(dui)于檢測(ce)不合(he)格(ge)的農(nong)資(zi)(zi)產(chan)品(pin)(pin),要及(ji)時(shi)(shi)對(dui)樣本(ben)基(ji)數、生產(chan)經(jing)營情況等事實(shi)進行證據固定(ding),及(ji)時(shi)(shi)依(yi)法(fa)(fa)公(gong)布檢測(ce)結果,并按(an)照《行政(zheng)處(chu)(chu)罰法(fa)(fa)》和(he)《農(nong)業行政(zheng)處(chu)(chu)罰程序規定(ding)》的要求(qiu),啟動處(chu)(chu)罰程序。

  (七)推(tui)進誠信建設,大力推(tui)進放(fang)心農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)下(xia)(xia)鄉進村。各地要(yao)結(jie)合實際,制(zhi)定(ding)科學合理、具有(you)可操作性的(de)(de)(de)信用(yong)等(deng)(deng)級評定(ding)標準(zhun)和(he)(he)辦法,根(gen)據農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)市場主(zhu)(zhu)體資(zi)(zi)質(zhi)、守法程(cheng)度(du)、消(xiao)費者投訴、公眾評價等(deng)(deng)相關信息,結(jie)合農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)質(zhi)量(liang)監督抽檢(jian)結(jie)果,評出(chu)信用(yong)等(deng)(deng)級,實行(xing)分類管理。在(zai)總結(jie)前幾(ji)年各地試點經(jing)(jing)驗(yan)的(de)(de)(de)基礎(chu)上(shang),開展放(fang)心農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)下(xia)(xia)鄉進村示(shi)范(fan)縣(市)建設,發揮示(shi)范(fan)效應。要(yao)大力推(tui)廣農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)連(lian)(lian)鎖、農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)農(nong)(nong)(nong)(nong)(nong)技“雙連(lian)(lian)鎖”、農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)行(xing)業(ye)協(xie)會等(deng)(deng)成功經(jing)(jing)驗(yan)和(he)(he)模式,積極探索農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)信用(yong)監管、農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)防(fang)偽等(deng)(deng)模式,努力構建覆蓋廣大農(nong)(nong)(nong)(nong)(nong)村的(de)(de)(de)新型農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)經(jing)(jing)營網絡。加強對農(nong)(nong)(nong)(nong)(nong)業(ye)部定(ding)點農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)市場的(de)(de)(de)跟蹤管理和(he)(he)后(hou)續指(zhi)導(dao),嚴(yan)格質(zhi)量(liang)控制(zhi)和(he)(he)賠償(chang)制(zhi)度(du),規范(fan)經(jing)(jing)營主(zhu)(zhu)體經(jing)(jing)營行(xing)為,提(ti)高信息服務等(deng)(deng)能(neng)力,切實發揮示(shi)范(fan)帶(dai)動作用(yong)。

  (八)突(tu)出“12316”三農(nong)(nong)(nong)(nong)熱線,強化服(fu)務(wu)(wu)指(zhi)導。全國已(yi)有16個省(區(qu)、市(shi)(shi))、257個地市(shi)(shi)、980個縣(xian)市(shi)(shi)開通(tong)“12316”三農(nong)(nong)(nong)(nong)服(fu)務(wu)(wu)熱線,要(yao)充(chong)分發揮(hui)“12316”公益服(fu)務(wu)(wu)電(dian)話(hua)的作用(yong),做好投訴舉報受(shou)理工作,為農(nong)(nong)(nong)(nong)民(min)群(qun)眾提供信息和(he)技術咨詢服(fu)務(wu)(wu)。未開通(tong)的省份,要(yao)積極創(chuang)造條件,加快“12316”三農(nong)(nong)(nong)(nong)熱線開通(tong)步伐。要(yao)強化對(dui)農(nong)(nong)(nong)(nong)民(min)群(qun)眾的服(fu)務(wu)(wu)指(zhi)導,提高農(nong)(nong)(nong)(nong)民(min)群(qun)眾質(zhi)量(liang)意識、科(ke)學(xue)使用(yong)農(nong)(nong)(nong)(nong)資能(neng)力(li)和(he)識假辨(bian)假維權能(neng)力(li)。要(yao)采取舉辦培訓班(ban)、印(yin)發宣傳資料(liao)、現場指(zhi)導等(deng)(deng)多種形(xing)式,深入(ru)普及農(nong)(nong)(nong)(nong)產品質(zhi)量(liang)安全法律知(zhi)識和(he)農(nong)(nong)(nong)(nong)業(ye)(ye)投入(ru)品使用(yong)知(zhi)識,指(zhi)導農(nong)(nong)(nong)(nong)民(min)科(ke)學(xue)、合理使用(yong)農(nong)(nong)(nong)(nong)業(ye)(ye)投入(ru)品,嚴(yan)格(ge)執行休藥期、安全間(jian)隔期等(deng)(deng)規定(ding),提高農(nong)(nong)(nong)(nong)民(min)規范化種植養殖技術水(shui)平。

  (九)強化鼠(shu)藥(yao)(yao)市(shi)(shi)場監管,鞏固(gu)毒(du)鼠(shu)強整治成果。各地農業部(bu)門(men)(men)要繼續(xu)采取(qu)市(shi)(shi)場監管、重點排查(cha)等(deng)措(cuo)施,加強鼠(shu)藥(yao)(yao)市(shi)(shi)場監管,堅決清繳毒(du)鼠(shu)強等(deng)劇毒(du)鼠(shu)藥(yao)(yao)。規(gui)范殺(sha)(sha)鼠(shu)劑市(shi)(shi)場流通渠道,嚴厲查(cha)處未(wei)取(qu)得經(jing)營資(zi)格經(jing)營殺(sha)(sha)鼠(shu)劑和經(jing)營沒有防偽標志殺(sha)(sha)鼠(shu)劑的(de)違(wei)法行(xing)為;加強統(tong)一滅鼠(shu)工作,宣傳推廣(guang)先(xian)進滅鼠(shu)器械、藥(yao)(yao)劑和技術(shu),提高(gao)鼠(shu)害綜(zong)合防治水平。配合公安部(bu)門(men)(men)做(zuo)好(hao)跟蹤、排查(cha)和搗毀(hui)制售毒(du)鼠(shu)強窩點等(deng)工作,協調環保部(bu)門(men)(men)做(zuo)好(hao)已(yi)收(shou)繳和廢棄毒(du)鼠(shu)強的(de)處置工作。

  (十(shi))落實(shi)監管(guan)(guan)責(ze)(ze)(ze)(ze)(ze)(ze)(ze)任,推(tui)進(jin)規范化(hua)(hua)建(jian)設。積極推(tui)進(jin)農(nong)(nong)資(zi)監管(guan)(guan)工(gong)(gong)(gong)作(zuo)規范化(hua)(hua)建(jian)設,形成穩定、有效的(de)(de)(de)農(nong)(nong)資(zi)監管(guan)(guan)機制。一是(shi)強化(hua)(hua)屬地(di)管(guan)(guan)理(li)責(ze)(ze)(ze)(ze)(ze)(ze)(ze)任。堅(jian)持以縣(xian)為主(zhu),由(you)縣(xian)級(ji)農(nong)(nong)業行(xing)政(zheng)(zheng)主(zhu)管(guan)(guan)部門(men)(men)(men)履(lv)(lv)行(xing)農(nong)(nong)資(zi)日(ri)常(chang)監管(guan)(guan)責(ze)(ze)(ze)(ze)(ze)(ze)(ze)任,并對本行(xing)政(zheng)(zheng)區域農(nong)(nong)資(zi)執(zhi)法(fa)(fa)工(gong)(gong)(gong)作(zuo)負(fu)責(ze)(ze)(ze)(ze)(ze)(ze)(ze),上級(ji)農(nong)(nong)業行(xing)政(zheng)(zheng)主(zhu)管(guan)(guan)部門(men)(men)(men)要加強指導(dao)、協調與(yu)服務工(gong)(gong)(gong)作(zuo)。二是(shi)推(tui)行(xing)執(zhi)法(fa)(fa)責(ze)(ze)(ze)(ze)(ze)(ze)(ze)任制度。縣(xian)級(ji)農(nong)(nong)業行(xing)政(zheng)(zheng)主(zhu)管(guan)(guan)部門(men)(men)(men)要與(yu)農(nong)(nong)資(zi)監管(guan)(guan)責(ze)(ze)(ze)(ze)(ze)(ze)(ze)任部門(men)(men)(men)簽訂責(ze)(ze)(ze)(ze)(ze)(ze)(ze)任書,明(ming)確職權、職責(ze)(ze)(ze)(ze)(ze)(ze)(ze)、目標、要求和保障(zhang)措施(shi),并報上一級(ji)農(nong)(nong)業部門(men)(men)(men)備案。三是(shi)嚴格(ge)落實(shi)責(ze)(ze)(ze)(ze)(ze)(ze)(ze)任追究制度。對監管(guan)(guan)措施(shi)不(bu)(bu)落實(shi)、該報告不(bu)(bu)報告、發現(xian)有違(wei)法(fa)(fa)行(xing)為的(de)(de)(de)苗(miao)頭不(bu)(bu)控制、該查處的(de)(de)(de)不(bu)(bu)查處、該移(yi)交的(de)(de)(de)不(bu)(bu)移(yi)交等(deng)行(xing)為,要及時予以處理(li);造(zao)成不(bu)(bu)良后果的(de)(de)(de),對主(zhu)要負(fu)責(ze)(ze)(ze)(ze)(ze)(ze)(ze)人(ren)、直接(jie)負(fu)責(ze)(ze)(ze)(ze)(ze)(ze)(ze)的(de)(de)(de)主(zhu)管(guan)(guan)人(ren)員和其他(ta)直接(jie)責(ze)(ze)(ze)(ze)(ze)(ze)(ze)任人(ren)員要依法(fa)(fa)處分。四是(shi)推(tui)行(xing)監管(guan)(guan)工(gong)(gong)(gong)作(zuo)記錄制度。具(ju)體履(lv)(lv)行(xing)農(nong)(nong)資(zi)監管(guan)(guan)職責(ze)(ze)(ze)(ze)(ze)(ze)(ze)的(de)(de)(de)機構(gou)要建(jian)立監管(guan)(guan)工(gong)(gong)(gong)作(zuo)記錄,如實(shi)記錄監管(guan)(guan)工(gong)(gong)(gong)作(zuo)開展情況。五是(shi)進(jin)一步完善信息報送和統計制度,逐(zhu)步實(shi)現(xian)電子化(hua)(hua)報送,網絡化(hua)(hua)管(guan)(guan)理(li)。

  三、保障措施

  (一)加(jia)強領(ling)(ling)(ling)導(dao),切實提高基層(ceng)農(nong)(nong)資(zi)(zi)監(jian)管(guan)能(neng)力(li)(li)。各(ge)級農(nong)(nong)業行政主管(guan)部門要切實加(jia)強農(nong)(nong)資(zi)(zi)監(jian)管(guan)工作(zuo)的領(ling)(ling)(ling)導(dao),建立主管(guan)領(ling)(ling)(ling)導(dao)負總責(ze)、分(fen)管(guan)領(ling)(ling)(ling)導(dao)具體(ti)抓、相(xiang)關部門分(fen)工負責(ze)的工作(zuo)體(ti)系(xi),充分(fen)發揮基層(ceng)執法機(ji)構在農(nong)(nong)資(zi)(zi)監(jian)管(guan)工作(zuo)中的主力(li)(li)軍作(zuo)用。要積極爭取將(jiang)農(nong)(nong)資(zi)(zi)監(jian)管(guan)工作(zuo)經(jing)費納入地方財政預(yu)算,保證基層(ceng)農(nong)(nong)資(zi)(zi)執法監(jian)管(guan)、抽檢和辦案經(jing)費,配(pei)備必(bi)要的交(jiao)通、通訊、計算機(ji)、照相(xiang)機(ji)等執法設備,保障農(nong)(nong)資(zi)(zi)監(jian)管(guan)工作(zuo)能(neng)落到實處。

  (二)強化協作(zuo),形成(cheng)打假工(gong)作(zuo)合(he)力(li)。各級(ji)農(nong)業部門(men)要在當地(di)黨委、政府的統(tong)一(yi)領導下,積極履行牽頭協調職責,加強與發(fa)展改革、公安(an)、工(gong)商、質(zhi)檢、供銷、監察、法院、檢察院等有關部門(men)的協作(zuo),落實農(nong)資(zi)打假部門(men)聯席會議(yi)制度,明確職責分工(gong),及時溝通信(xin)息(xi),制定聯合(he)行動(dong)(dong)計劃,進(jin)一(yi)步健全部門(men)內各盡(jin)其職,各負(fu)其責,部門(men)間相(xiang)互(hu)支持(chi)、相(xiang)互(hu)配合(he)的農(nong)資(zi)打假工(gong)作(zuo)機(ji)制,充分發(fa)揮多部門(men)整體聯動(dong)(dong)的優勢,形成(cheng)農(nong)資(zi)打假工(gong)作(zuo)合(he)力(li)。

  (三)深入宣傳,營(ying)造全(quan)民(min)打假(jia)氛圍。要充分發揮輿論監(jian)督(du)和宣傳導向作用,利用電(dian)視、廣播、網絡、報刊、明白紙、宣傳單等(deng)多種(zhong)手段(duan),宣傳農資(zi)打假(jia)工(gong)作經驗和成效,宣傳農資(zi)法(fa)(fa)律(lv)法(fa)(fa)規,加大(da)假(jia)劣農資(zi)案件曝光力度,震懾違(wei)法(fa)(fa)犯罪分子。

  (四)加(jia)強督查(cha)考(kao)核,確保(bao)各(ge)(ge)項工作落(luo)實。加(jia)強對(dui)(dui)各(ge)(ge)級(ji)農(nong)業部門農(nong)資(zi)監(jian)管職責(ze)(ze)落(luo)實情況的(de)(de)督查(cha)力(li)度(du)(du),實行目標考(kao)核,嚴(yan)(yan)格(ge)落(luo)實責(ze)(ze)任(ren)追究制(zhi)度(du)(du),對(dui)(dui)不認真履行農(nong)資(zi)監(jian)管職責(ze)(ze)的(de)(de),要(yao)通報(bao)批(pi)評;對(dui)(dui)嚴(yan)(yan)格(ge)履行監(jian)管職責(ze)(ze)、措施得力(li)、工作成效顯著的(de)(de)單位和個人要(yao)進行表(biao)彰獎(jiang)勵。

  四、重點活動

  (一)2月,組織(zhi)召開(kai)全國農(nong)資打假專項治理行(xing)動電(dian)(dian)視(shi)電(dian)(dian)話會議,部署2008年農(nong)資打假和(he)監(jian)管(guan)工(gong)作。

  (二(er))2-4月,組織開展農資打(da)假專項(xiang)治理春季行動。

  (三(san))3月,組織開展第四屆“放心農資(zi)下(xia)鄉(xiang)進(jin)村宣(xuan)傳周”活動。

  (四)3月(yue),啟(qi)動放心農資下(xia)鄉進村示范縣(xian)(市)建設。

  (五)“3.15”期間(jian),公布全國農業系統農資打(da)假典(dian)型案例。

  (六)4月,組織(zhi)開展農資打假專項治理春(chun)季(ji)督查。

  (七(qi))春季(ji)(ji)和秋(qiu)季(ji)(ji)等重(zhong)要農時(shi),組織開展農資質量(liang)監督抽(chou)(chou)查(cha)活動(dong),及時(shi)公布抽(chou)(chou)查(cha)結果。

  (八(ba))9-11月,組織(zhi)開展農資打假專(zhuan)項(xiang)治理秋(qiu)季(ji)行動(dong)。

  (九(jiu))10-11月(yue),組織(zhi)開(kai)展農資監管責(ze)任制落實情況檢查活動。
