2004年(nian),在黨中(zhong)央(yang)、國(guo)務院的正確領(ling)導下(xia),按照全(quan)國(guo)整頓和規(gui)范(fan)市場(chang)經濟(ji)秩序領(ling)導小組的統一部(bu)署,各(ge)地、各(ge)部(bu)門密切配合、扎實(shi)工(gong)(gong)作,農(nong)(nong)(nong)資(zi)(zi)打(da)假(jia)工(gong)(gong)作取得(de)了新的進展。總體看,農(nong)(nong)(nong)資(zi)(zi)質量水平有所提高,市場(chang)秩序逐步好轉,但非法制售(shou)假(jia)劣農(nong)(nong)(nong)資(zi)(zi)問題(ti)尚未得(de)到徹(che)底解決,假(jia)劣農(nong)(nong)(nong)資(zi)(zi)坑農(nong)(nong)(nong)害農(nong)(nong)(nong)事件時(shi)有發生。為認真(zhen)貫徹(che)黨的十(shi)六(liu)大,十(shi)六(liu)屆三(san)中(zhong)、四中(zhong)全(quan)會(hui)和中(zhong)央(yang)經濟(ji)工(gong)(gong)作會(hui)議(yi)、中(zhong)央(yang)農(nong)(nong)(nong)村工(gong)(gong)作會(hui)議(yi)精神,全(quan)面落實(shi)《中(zhong)共中(zhong)央(yang)國(guo)務院關于進一步加強農(nong)(nong)(nong)村工(gong)(gong)作提高農(nong)(nong)(nong)業綜合生產能力若干政策的意見(jian)》要求,現就2005年(nian)農(nong)(nong)(nong)資(zi)(zi)打(da)假(jia)工(gong)(gong)作提出如下(xia)意見(jian)。
一(yi)、提高認識,增強農資打假(jia)工作的責任感
農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)是(shi)(shi)農(nong)(nong)(nong)(nong)(nong)業(ye)生產(chan)的(de)(de)(de)基(ji)本要(yao)(yao)(yao)素。農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)質量(liang)優劣(lie)直(zhi)接關(guan)(guan)系(xi)到農(nong)(nong)(nong)(nong)(nong)業(ye)增效、農(nong)(nong)(nong)(nong)(nong)民增收和農(nong)(nong)(nong)(nong)(nong)產(chan)品競爭力(li)增強,也(ye)關(guan)(guan)系(xi)到農(nong)(nong)(nong)(nong)(nong)業(ye)綜合生產(chan)能(neng)力(li)的(de)(de)(de)提高(gao)(gao)。大(da)力(li)整頓和規(gui)范農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)市場(chang)秩序(xu),既是(shi)(shi)政府部門切實(shi)履(lv)行(xing)市場(chang)監管職能(neng)的(de)(de)(de)內在要(yao)(yao)(yao)求,也(ye)是(shi)(shi)促進農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)產(chan)業(ye)健康發展,完善社會主義市場(chang)經(jing)濟(ji)體(ti)制(zhi)的(de)(de)(de)基(ji)本前提和重(zhong)要(yao)(yao)(yao)內容。深入開展農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)打假工作(zuo)(zuo),既是(shi)(shi)農(nong)(nong)(nong)(nong)(nong)業(ye)和農(nong)(nong)(nong)(nong)(nong)村經(jing)濟(ji)工作(zuo)(zuo)進入新(xin)階段(duan)后提高(gao)(gao)農(nong)(nong)(nong)(nong)(nong)業(ye)綜合生產(chan)能(neng)力(li)的(de)(de)(de)現實(shi)需要(yao)(yao)(yao),也(ye)是(shi)(shi)切實(shi)保護農(nong)(nong)(nong)(nong)(nong)民權益,維護農(nong)(nong)(nong)(nong)(nong)村社會穩定,體(ti)現執政為(wei)民的(de)(de)(de)具體(ti)行(xing)動。各(ge)(ge)地(di)、各(ge)(ge)部門要(yao)(yao)(yao)站在全(quan)局的(de)(de)(de)高(gao)(gao)度,準確把握(wo)當前農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)市場(chang)形勢,進一步增強責(ze)任感(gan)和緊(jin)迫感(gan),結合當地(di)實(shi)際,研究制(zhi)定有針對(dui)性(xing)的(de)(de)(de)措施(shi),把農(nong)(nong)(nong)(nong)(nong)資(zi)(zi)打假作(zuo)(zuo)為(wei)一項重(zhong)點工作(zuo)(zuo)列(lie)入日(ri)常議事日(ri)程抓緊(jin)抓好。
二、理清(qing)思路(lu),進(jin)一(yi)步明(ming)確農資打假的目標
2005年全(quan)國(guo)農(nong)(nong)資(zi)打(da)(da)假工作的總體思路和(he)(he)目(mu)標是,全(quan)面貫徹黨的十(shi)六大(da)(da)和(he)(he)十(shi)六屆三中(zhong)(zhong)、四中(zhong)(zhong)全(quan)會精神,牢(lao)固樹立和(he)(he)落實(shi)科學發展觀,堅(jian)持“著力(li)(li)治(zhi)(zhi)(zhi)本、標本兼治(zhi)(zhi)(zhi),打(da)(da)防結合、綜合治(zhi)(zhi)(zhi)理”原則(ze)(ze),嚴把生(sheng)產(chan)、流通和(he)(he)使用三個(ge)關口(kou),大(da)(da)力(li)(li)促(cu)進放(fang)心農(nong)(nong)資(zi)供(gong)應(ying),嚴厲打(da)(da)擊制(zhi)(zhi)售(shou)假劣農(nong)(nong)資(zi)行(xing)為(wei)。堅(jian)持突(tu)出重點(dian)和(he)(he)整體推進相結合,集(ji)中(zhong)(zhong)整治(zhi)(zhi)(zhi)和(he)(he)制(zhi)(zhi)度(du)建設相結合,按照屬地(di)管理原則(ze)(ze),進一步(bu)強化地(di)方責(ze)任,完善工作機制(zhi)(zhi),增(zeng)加農(nong)(nong)資(zi)打(da)(da)假投入,加大(da)(da)執法力(li)(li)度(du),做到(dao)統一部署,分工合作,上下聯(lian)動(dong),打(da)(da)假扶優。通過各(ge)地(di)、各(ge)部門(men)的共同努力(li)(li),使農(nong)(nong)資(zi)市場秩序得到(dao)明顯好轉,非法制(zhi)(zhi)售(shou)假劣農(nong)(nong)資(zi)的違法犯(fan)罪活動(dong)得到(dao)有效遏制(zhi)(zhi),大(da)(da)案要(yao)案得到(dao)及時(shi)查處,因農(nong)(nong)資(zi)質量問(wen)題引(yin)發的農(nong)(nong)業生(sheng)產(chan)事故大(da)(da)幅度(du)下降(jiang)。同時(shi),積(ji)極引(yin)導建立新型農(nong)(nong)資(zi)產(chan)銷(xiao)機制(zhi)(zhi),逐步(bu)擴大(da)(da)放(fang)心農(nong)(nong)資(zi)產(chan)品覆蓋率,不斷增(zeng)強農(nong)(nong)資(zi)生(sheng)產(chan)經營單(dan)位守法誠信(xin)意識,切實(shi)提(ti)高(gao)農(nong)(nong)民維權意識和(he)(he)能力(li)(li)。
三(san)、加(jia)強(qiang)監管,嚴(yan)厲打(da)擊制售假(jia)劣農資行(xing)為
(一(yi))切實突出(chu)監管(guan)工(gong)(gong)(gong)作(zuo)(zuo)重(zhong)(zhong)點(dian)。在切實抓(zhua)好七大類農資(zi)市(shi)場整(zheng)頓的同時(shi),以種子、農藥、肥料(liao)、飼(si)料(liao)、獸(shou)藥為(wei)重(zhong)(zhong)點(dian)品種,集中力(li)量組織開展專項整(zheng)治(zhi)。要(yao)將監管(guan)的重(zhong)(zhong)點(dian)和(he)工(gong)(gong)(gong)作(zuo)(zuo)重(zhong)(zhong)心下移,加大縣、鄉農資(zi)批發(fa)市(shi)場、專業市(shi)場,以及鄉、村農資(zi)集散地(di)和(he)經營單(dan)位(門店、攤(tan)點(dian))的整(zheng)頓力(li)度(du),嚴厲打(da)擊非法(fa)制售假劣農資(zi)的違法(fa)違規行為(wei)。同時(shi),要(yao)繼續深入推進(jin)毒(du)鼠(shu)強(qiang)(qiang)專項整(zheng)治(zhi)工(gong)(gong)(gong)作(zuo)(zuo),逐步納(na)入日常監管(guan)。通過置換等方(fang)(fang)法(fa)開展清查收繳,千(qian)方(fang)(fang)百計地(di)將仍流散在民(min)間的毒(du)鼠(shu)強(qiang)(qiang)等劇毒(du)鼠(shu)藥收繳上(shang)來;做(zuo)好產銷對接,抓(zhua)好殺(sha)鼠(shu)劑供應工(gong)(gong)(gong)作(zuo)(zuo),暢(chang)通殺(sha)鼠(shu)劑市(shi)場流通渠道;加強(qiang)(qiang)統一(yi)滅(mie)鼠(shu)工(gong)(gong)(gong)作(zuo)(zuo),推廣先進(jin)的滅(mie)鼠(shu)方(fang)(fang)法(fa),鞏(gong)固專項整(zheng)治(zhi)成果(guo),切實防(fang)止反(fan)彈。
(二(er))大力整頓農(nong)資生(sheng)(sheng)(sheng)(sheng)產(chan)(chan)企(qi)業(ye)(ye)。要(yao)加(jia)強對生(sheng)(sheng)(sheng)(sheng)產(chan)(chan)企(qi)業(ye)(ye)的(de)監(jian)管,強化企(qi)業(ye)(ye)法人作(zuo)為(wei)農(nong)資質(zhi)量第一(yi)責任人的(de)責任,督促(cu)企(qi)業(ye)(ye)嚴(yan)格(ge)按標準(zhun)組織(zhi)生(sheng)(sheng)(sheng)(sheng)產(chan)(chan),嚴(yan)格(ge)產(chan)(chan)品出廠(chang)檢(jian)驗,堅(jian)決(jue)杜絕不合(he)格(ge)農(nong)資流入(ru)市場。加(jia)大執法打假(jia)力度,嚴(yan)肅查處(chu)無(wu)(wu)營業(ye)(ye)執照、無(wu)(wu)生(sheng)(sheng)(sheng)(sheng)產(chan)(chan)許可證(zheng)(zheng)、無(wu)(wu)生(sheng)(sheng)(sheng)(sheng)產(chan)(chan)批準(zhun)證(zheng)(zheng)書、無(wu)(wu)國(guo)家強制性認(ren)證(zheng)(zheng)證(zheng)(zheng)書、無(wu)(wu)產(chan)(chan)品登記證(zheng)(zheng)、無(wu)(wu)產(chan)(chan)品批準(zhun)文號的(de)生(sheng)(sheng)(sheng)(sheng)產(chan)(chan)經(jing)營行為(wei);嚴(yan)厲(li)查處(chu)農(nong)資生(sheng)(sheng)(sheng)(sheng)產(chan)(chan)企(qi)業(ye)(ye)質(zhi)量違法行為(wei),堅(jian)決(jue)取締生(sheng)(sheng)(sheng)(sheng)產(chan)(chan)假(jia)冒偽劣和有嚴(yan)重產(chan)(chan)品質(zhi)量問題(ti)的(de)農(nong)資企(qi)業(ye)(ye)。
(三)狠抓市場流通薄弱(ruo)環節。根(gen)據(ju)目前農(nong)資(zi)(zi)(zi)(zi)市場存在的(de)突出問題,結(jie)合重(zhong)要農(nong)時(shi)季節,組(zu)織開展(zhan)拉網(wang)式檢(jian)(jian)查(cha)(cha)(cha)(cha)。一要重(zhong)點檢(jian)(jian)查(cha)(cha)(cha)(cha)產(chan)品(pin)(pin)標(biao)簽,嚴肅(su)(su)(su)查(cha)(cha)(cha)(cha)處(chu)(chu)無(wu)(wu)產(chan)品(pin)(pin)登記證(zheng)號(hao)(hao)、批(pi)準文號(hao)(hao)、品(pin)(pin)種審定、生產(chan)許(xu)可證(zheng)號(hao)(hao)、經(jing)(jing)(jing)營(ying)許(xu)可證(zheng)號(hao)(hao)、國(guo)家強制性認(ren)證(zheng)標(biao)志(zhi),或虛(xu)假(jia)標(biao)注、隨意擴大防治作物和對(dui)象范(fan)圍(wei)(wei)(wei)、隨意更改農(nong)藥(yao)毒性標(biao)志(zhi),以及假(jia)冒(mao)仿冒(mao)產(chan)品(pin)(pin)商(shang)標(biao)等違(wei)法行為。二是要重(zhong)點檢(jian)(jian)查(cha)(cha)(cha)(cha)市場主體證(zheng)照是否齊全,嚴肅(su)(su)(su)查(cha)(cha)(cha)(cha)處(chu)(chu)無(wu)(wu)證(zheng)經(jing)(jing)(jing)營(ying)、借證(zheng)經(jing)(jing)(jing)營(ying)、超范(fan)圍(wei)(wei)(wei)經(jing)(jing)(jing)營(ying)和不具(ju)備資(zi)(zi)(zi)(zi)格(ge)條(tiao)件(jian)而經(jing)(jing)(jing)營(ying)等違(wei)法行為,堅決取締無(wu)(wu)證(zheng)生產(chan)企業,依(yi)法清(qing)理不符合條(tiao)件(jian)的(de)生產(chan)經(jing)(jing)(jing)營(ying)單位(wei)。三是重(zhong)點檢(jian)(jian)查(cha)(cha)(cha)(cha)產(chan)品(pin)(pin)廣(guang)(guang)告,嚴肅(su)(su)(su)查(cha)(cha)(cha)(cha)處(chu)(chu)利用各種廣(guang)(guang)告或媒體對(dui)農(nong)資(zi)(zi)(zi)(zi)產(chan)品(pin)(pin)質(zhi)量、服務、功效(xiao)、適用范(fan)圍(wei)(wei)(wei)進(jin)行虛(xu)假(jia)宣傳等違(wei)法行為。四是重(zhong)點檢(jian)(jian)查(cha)(cha)(cha)(cha)產(chan)品(pin)(pin)質(zhi)量。要擴大抽(chou)(chou)檢(jian)(jian)范(fan)圍(wei)(wei)(wei),提高(gao)抽(chou)(chou)檢(jian)(jian)密(mi)度,廣(guang)(guang)泛組(zu)織開展(zhan)農(nong)資(zi)(zi)(zi)(zi)質(zhi)量抽(chou)(chou)檢(jian)(jian),并及時(shi)公布檢(jian)(jian)測結(jie)果,集(ji)中(zhong)清(qing)繳(jiao)假(jia)劣農(nong)資(zi)(zi)(zi)(zi)和國(guo)家明令(ling)禁用農(nong)資(zi)(zi)(zi)(zi),依(yi)法對(dui)違(wei)法經(jing)(jing)(jing)營(ying)單位(wei)嚴肅(su)(su)(su)處(chu)(chu)理。
在市(shi)場(chang)(chang)(chang)整頓中,要在農(nong)資批發(fa)市(shi)場(chang)(chang)(chang)、專業(ye)市(shi)場(chang)(chang)(chang)和(he)集(ji)散地推行(xing)市(shi)場(chang)(chang)(chang)開(kai)辦者質(zhi)量責任制,積極(ji)推動(dong)農(nong)資經(jing)銷企(qi)業(ye)落實進(jin)貨檢(jian)查驗收(shou)、索證索票、購(gou)銷臺賬和(he)質(zhi)量承諾制度,督(du)促(cu)經(jing)銷單位做好售后(hou)服務(wu),逐步規(gui)范農(nong)資生產經(jing)營(ying)行(xing)為。
(四)嚴(yan)肅查(cha)處一批(pi)大案(an)(an)(an)要(yao)(yao)案(an)(an)(an)。要(yao)(yao)對(dui)近年來假劣(lie)農(nong)資案(an)(an)(an)件線索進行認真梳理,確定一批(pi)重點案(an)(an)(an)件,組織(zhi)力量集中(zhong)查(cha)處。同時,繼續(xu)組織(zhi)開展明察暗訪(fang),狠抓(zhua)重點地(di)區(qu)和(he)重點企(qi)業(ye),對(dui)集中(zhong)制(zhi)假售假的(de)地(di)區(qu)加(jia)大整(zheng)治和(he)督辦案(an)(an)(an)件的(de)力度,做好跟(gen)蹤工(gong)作,堅(jian)決按照(zhao)“五不(bu)放過”原則一查(cha)到底,嚴(yan)肅查(cha)處一批(pi)大案(an)(an)(an)要(yao)(yao)案(an)(an)(an),嚴(yan)懲違(wei)法犯(fan)罪(zui)分子(zi)。加(jia)大典型案(an)(an)(an)件的(de)曝光與宣(xuan)傳力度,震懾違(wei)法犯(fan)罪(zui)分子(zi),教育廣大群(qun)眾。要(yao)(yao)嚴(yan)肅責(ze)任追(zhui)究,確保打擊(ji)力度,對(dui)在查(cha)辦制(zhi)售假冒偽劣(lie)農(nong)資產(chan)品案(an)(an)(an)件中(zhong)玩忽職(zhi)守(shou)、濫用職(zhi)權、徇私舞弊(bi)的(de),要(yao)(yao)予以嚴(yan)肅查(cha)處。構成犯(fan)罪(zui)的(de),要(yao)(yao)堅(jian)決依法追(zhui)究責(ze)任人的(de)刑事責(ze)任。
(五)加快推(tui)進農資(zi)信(xin)(xin)用建(jian)設。要根(gen)據監督檢查結果和市場主(zhu)體資(zi)格審(shen)查、消費者投訴、公(gong)眾評價等(deng)相關信(xin)(xin)息,建(jian)立監管對(dui)象誠信(xin)(xin)檔案,實施信(xin)(xin)用等(deng)級分類監管。對(dui)信(xin)(xin)譽好(hao)的企(qi)業要在證照(zhao)年審(shen)、登記(ji)續展(zhan)等(deng)方面給(gei)予扶持(chi)和鼓勵(li),對(dui)失信(xin)(xin)企(qi)業要予以警示或限期(qi)整改,對(dui)違法次數多性質(zhi)嚴重的企(qi)業要列入“黑名單”向社會(hui)公(gong)布并重點監控(kong)。要積極引導(dao)農資(zi)行業推(tui)行質(zhi)量公(gong)開(kai)承(cheng)諾制,切實加強(qiang)行業自律。
四、扶(fu)優扶(fu)強(qiang),大(da)力(li)促(cu)進放(fang)心農資(zi)供應
(一)積極扶持(chi)(chi)一批(pi)優(you)(you)(you)(you)勢企(qi)(qi)業(ye)。要認真(zhen)落實國家對(dui)(dui)農資生(sheng)(sheng)產(chan)企(qi)(qi)業(ye)在稅收、運輸等方面的優(you)(you)(you)(you)惠措施(shi),保證(zheng)農資生(sheng)(sheng)產(chan)企(qi)(qi)業(ye)生(sheng)(sheng)產(chan)所(suo)需的能(neng)源和原(yuan)材料(liao)供應,支持(chi)(chi)優(you)(you)(you)(you)勢企(qi)(qi)業(ye)發(fa)展農資生(sheng)(sheng)產(chan)。充分利(li)用國家扶持(chi)(chi)農業(ye)發(fa)展的各(ge)(ge)項政(zheng)策,通過政(zheng)府(fu)統(tong)一采購、招標投標等有效(xiao)手段,鼓勵生(sheng)(sheng)產(chan)企(qi)(qi)業(ye)與農村各(ge)(ge)類(lei)合(he)作經(jing)濟(ji)組(zu)織對(dui)(dui)接,扶持(chi)(chi)優(you)(you)(you)(you)勢企(qi)(qi)業(ye)不(bu)斷(duan)發(fa)展壯大(da)。
(二)加快完(wan)(wan)善農(nong)(nong)資(zi)營(ying)銷網(wang)(wang)絡(luo)。要在農(nong)(nong)資(zi)連(lian)(lian)(lian)鎖經(jing)營(ying)企(qi)業(ye)(ye)中建立聯(lian)(lian)系點,發(fa)揮聯(lian)(lian)系點的示范作(zuo)用,指導連(lian)(lian)(lian)鎖經(jing)營(ying)企(qi)業(ye)(ye)健康發(fa)展,及時(shi)總結典型(xing)經(jing)驗,因地(di)制宜進(jin)行(xing)推廣。大力發(fa)展連(lian)(lian)(lian)鎖經(jing)營(ying)、物流配送、電子商(shang)務、代(dai)理專賣、農(nong)(nong)資(zi)超市等現代(dai)流通組織方(fang)式(shi)和經(jing)營(ying)方(fang)式(shi),不斷完(wan)(wan)善農(nong)(nong)資(zi)營(ying)銷網(wang)(wang)絡(luo)。要鼓勵經(jing)濟實力強、管(guan)理水平高、誠信(xin)守法的農(nong)(nong)資(zi)經(jing)營(ying)企(qi)業(ye)(ye)依法到(dao)鄉(xiang)、村設立經(jing)營(ying)網(wang)(wang)點,擴大放心(xin)農(nong)(nong)資(zi)的覆蓋(gai)面,提高放心(xin)農(nong)(nong)資(zi)的市場(chang)占有(you)率。要結合當地(di)實際,舉(ju)辦農(nong)(nong)資(zi)產品(pin)展銷會、交易會等活動(dong),加大農(nong)(nong)資(zi)產銷銜接力度(du)。
(三)及時推介一批放心(xin)產品。要采取得力措施,在(zai)春耕備耕期間及其他重(zhong)要農(nong)(nong)(nong)(nong)時季節(jie),及時發(fa)布(bu)農(nong)(nong)(nong)(nong)資(zi)(zi)質量(liang)和供求(qiu)信息,充(chong)分發(fa)揮(hui)農(nong)(nong)(nong)(nong)業技(ji)術(shu)(shu)推廣部門和農(nong)(nong)(nong)(nong)資(zi)(zi)行業協會(hui)的(de)(de)作用,積極向(xiang)農(nong)(nong)(nong)(nong)民(min)群眾(zhong)推介新(xin)品種、新(xin)技(ji)術(shu)(shu),引導農(nong)(nong)(nong)(nong)民(min)群眾(zhong)選(xuan)購放心(xin)農(nong)(nong)(nong)(nong)資(zi)(zi)產品。要發(fa)揮(hui)農(nong)(nong)(nong)(nong)村各類(lei)合(he)作經濟組織的(de)(de)紐帶(dai)作用,帶(dai)動和幫助農(nong)(nong)(nong)(nong)民(min)購買放心(xin)農(nong)(nong)(nong)(nong)資(zi)(zi)。同(tong)時,要加強對(dui)農(nong)(nong)(nong)(nong)民(min)的(de)(de)技(ji)術(shu)(shu)培訓和售后服務,開展(zhan)技(ji)物(wu)結合(he)活(huo)動,指(zhi)導農(nong)(nong)(nong)(nong)民(min)正確(que)、科學選(xuan)購和使(shi)用農(nong)(nong)(nong)(nong)資(zi)(zi),防止因使(shi)用不(bu)當造成農(nong)(nong)(nong)(nong)業生產事(shi)故。
五、加強領導,完善各項保(bao)障措施(shi)
(一(yi))落實(shi)責任,切(qie)實(shi)加強(qiang)農(nong)(nong)資(zi)打假(jia)(jia)工(gong)作的組(zu)(zu)織領導(dao)(dao)。各(ge)地、各(ge)部(bu)(bu)門(men)要(yao)(yao)(yao)形(xing)成主要(yao)(yao)(yao)負(fu)責同(tong)志親自抓,分(fen)管領導(dao)(dao)同(tong)志具(ju)體抓的工(gong)作機制(zhi),切(qie)實(shi)加強(qiang)農(nong)(nong)資(zi)打假(jia)(jia)工(gong)作的組(zu)(zu)織領導(dao)(dao)。要(yao)(yao)(yao)嚴(yan)格實(shi)行(xing)(xing)分(fen)級負(fu)責,層(ceng)層(ceng)建立責任制(zhi)和(he)責任追究制(zhi)度(du)。要(yao)(yao)(yao)加強(qiang)監督(du)檢查(cha),積(ji)極開展農(nong)(nong)資(zi)打假(jia)(jia)考核(he)評價(jia)工(gong)作。對工(gong)作不(bu)力,或發生(sheng)重大假(jia)(jia)劣農(nong)(nong)資(zi)案(an)件,造成農(nong)(nong)民嚴(yan)重損失和(he)惡劣社(she)會(hui)影響的地區(qu),要(yao)(yao)(yao)及時(shi)報請有關部(bu)(bu)門(men)追究相關責任人員的責任。全國(guo)農(nong)(nong)資(zi)打假(jia)(jia)專項斗爭部(bu)(bu)際協調(diao)小組(zu)(zu)將(jiang)適(shi)時(shi)組(zu)(zu)成聯合(he)督(du)查(cha)組(zu)(zu)對農(nong)(nong)資(zi)打假(jia)(jia)工(gong)作情況進行(xing)(xing)督(du)查(cha)和(he)指導(dao)(dao)。
(二)明確分工,加(jia)(jia)強(qiang)部(bu)(bu)門間的協調與配合。各有(you)關(guan)部(bu)(bu)門要(yao)在當地政府的統一(yi)領導下(xia),加(jia)(jia)大(da)農(nong)資打假(jia)(jia)和監管(guan)(guan)工作(zuo)(zuo)力度(du)。農(nong)業部(bu)(bu)門要(yao)充(chong)分發揮(hui)牽頭與協調作(zuo)(zuo)用(yong),各部(bu)(bu)門依據職責主動(dong)開展(zhan)(zhan)監管(guan)(guan)和打假(jia)(jia)工作(zuo)(zuo)。要(yao)加(jia)(jia)強(qiang)相互之間的信(xin)息(xi)交流與溝通(tong),特別是(shi)縣級(ji)各部(bu)(bu)門之間要(yao)及時(shi)通(tong)報信(xin)息(xi),建(jian)立信(xin)息(xi)共享機(ji)制,切實形成齊抓共管(guan)(guan)的整(zheng)體(ti)效能。行政執(zhi)法機(ji)關(guan)要(yao)與司法機(ji)關(guan)經常(chang)性召(zhao)開聯席會議,通(tong)報大(da)案(an)(an)要(yao)案(an)(an),開展(zhan)(zhan)聯合調查研究,及時(shi)解決農(nong)資打假(jia)(jia)工作(zuo)(zuo)中(zhong)遇(yu)到的法律適用(yong)等(deng)問題。
(三)廣泛(fan)宣(xuan)傳,努(nu)力(li)營造農(nong)(nong)(nong)資(zi)(zi)(zi)(zi)打假(jia)(jia)(jia)工作(zuo)氛圍。要充分發揮輿論(lun)宣(xuan)傳在農(nong)(nong)(nong)資(zi)(zi)(zi)(zi)打假(jia)(jia)(jia)中(zhong)的導向和(he)監(jian)督作(zuo)用,通(tong)過電視、廣播、網絡、報刊等多種媒體,利用印發明(ming)白紙、宣(xuan)傳單、懸掛橫幅標(biao)語等各種群眾喜聞(wen)樂見的形(xing)式,大力(li)推(tui)介優質放心農(nong)(nong)(nong)資(zi)(zi)(zi)(zi),樹立農(nong)(nong)(nong)資(zi)(zi)(zi)(zi)品牌消費意(yi)識;介紹農(nong)(nong)(nong)資(zi)(zi)(zi)(zi)識假(jia)(jia)(jia)辨假(jia)(jia)(jia)和(he)使用常識,廣泛(fan)宣(xuan)傳農(nong)(nong)(nong)資(zi)(zi)(zi)(zi)法律(lv)法規,切(qie)實提高農(nong)(nong)(nong)民維權(quan)意(yi)識和(he)能力(li);組織曝(pu)光(guang)一批典型(xing)假(jia)(jia)(jia)劣(lie)農(nong)(nong)(nong)資(zi)(zi)(zi)(zi)案件(jian),震懾違法犯罪分子(zi),形(xing)成全社會關心和(he)支持農(nong)(nong)(nong)資(zi)(zi)(zi)(zi)打假(jia)(jia)(jia)的工作(zuo)氛圍。
(四)增加投(tou)(tou)入,完善基(ji)層執(zhi)(zhi)法(fa)(fa)體系建設。要積極爭取財政(zheng)投(tou)(tou)入,穩定(ding)執(zhi)(zhi)法(fa)(fa)隊伍,加強基(ji)層執(zhi)(zhi)法(fa)(fa)隊伍建設,提(ti)高(gao)執(zhi)(zhi)法(fa)(fa)隊伍素(su)質(zhi)和能力,改善執(zhi)(zhi)法(fa)(fa)裝備,規范執(zhi)(zhi)法(fa)(fa)行為。穩步推進縣級農業綜(zong)合執(zhi)(zhi)法(fa)(fa)試點,相(xiang)對集中農業行政(zheng)處(chu)罰權(quan),提(ti)高(gao)農業行政(zheng)執(zhi)(zhi)法(fa)(fa)能力。要主(zhu)動(dong)研究建立部門間(jian)的聯(lian)合執(zhi)(zhi)法(fa)(fa)協作工作機制(zhi),切實避免多頭執(zhi)(zhi)法(fa)(fa)、重復執(zhi)(zhi)法(fa)(fa)等問題。加大行政(zheng)執(zhi)(zhi)法(fa)(fa)與(yu)刑事(shi)執(zhi)(zhi)法(fa)(fa)相(xiang)銜接力度,涉嫌構成犯罪的,及(ji)時移送公安(an)機關依法(fa)(fa)查處(chu)。
(五(wu))完善(shan)(shan)制度(du),逐(zhu)步(bu)建(jian)立農(nong)(nong)資(zi)打假(jia)長(chang)效機(ji)制。一要建(jian)立健全案(an)件(jian)上報(bao)(bao)和重(zhong)大(da)案(an)件(jian)督辦制度(du)。對(dui)重(zhong)大(da)的假(jia)劣農(nong)(nong)資(zi)案(an)件(jian),要及(ji)時逐(zhu)級上報(bao)(bao),不得瞞報(bao)(bao)、漏報(bao)(bao)。二要完善(shan)(shan)投(tou)訴(su)舉(ju)報(bao)(bao)制度(du)。加強各級投(tou)訴(su)舉(ju)報(bao)(bao)受理機(ji)構建(jian)設(she),暢通投(tou)訴(su)舉(ju)報(bao)(bao)渠道,落實(shi)投(tou)訴(su)舉(ju)報(bao)(bao)獎勵,鼓勵社(she)會各界積(ji)極參與農(nong)(nong)資(zi)打假(jia)工作。三(san)要完善(shan)(shan)質量(liang)預警制度(du)。對(dui)重(zhong)點地區、重(zhong)點市場、重(zhong)點產品、重(zhong)點生產企業和經營單位,進行動態質量(liang)抽檢,增強質量(liang)預警和防范(fan)能力。
